TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS:

On or about the 28th day of October, 2019 the Town
of Monterey will submit a request to the Commonwealth of Massachusetts De­partment
of Housing and Community De­velopment (DHCD) for the release of CDBG funds
under Title I of the Housing and Community Develop­ment Act 1974 (PL 93-383) as
amended to undertake a project known as the Monterey Housing Rehabilita­tion
Program for the purpose of completing moderate rehabilitation of homes in the
towns of Monterey, Sandisfield and Egremont totaling up to $ 1,137,000.

The activity pro­posed is categorically excluded
under HUD regulations at 24 CFR Part 58 from the Nation­al Environmental Policy
Act (NEPA) require­ments. An Environ­mental Review Record (ERR) that documents
the environmental de­terminations for this project is on file at Monterey Town Hall and is available for public
examination and copying, upon request weekdays between the hours of 8:30 a.m.
and 4:00 p.m.

PUBLIC COMMENTS

Any individual, group, or agency may submit written
com­ments on the ERR to Kenneth Basler, Chairman of the Board of Selectmen at Mon­terey Town Hall on or before October 27, 2019.
All such com­ments so received will be considered prior to authorized
submission of a request for release of funds.

RELEASE OF FUNDS

The Town of Mon­terey
certifies to DHCD that Kenneth Basler, in his official capacity as Chairman of
the Board of Selectmen, consents to accept the jurisdiction of the Federal
Courts if an action is brought to enforce responsibili­ties in relation to the
environmental review process and that these responsibilities have been
satisfied. HUD’s and Massachusetts DHCD’s approval of the certification
satisfies its responsibilities under NEPA and related laws and authorities and
al­lows the Town of Mon­terey
to use Program funds.

OBJECTION TO RE­LEASE OF FUNDS

Massachusetts DHCD will accept ob­jections to its
release of fund and the Town of Monterey certifica­tion for a period of fifteen
days following the anticipated submis­sion date or its actual receipt of the
request (whichever is later) only if they are on one of the following bases:

a) The certification was not in fact ex­ecuted by
the Town’s Certifying Officer; b) The Town has omitted a step or failed to make
a decision or finding re­quired by HUD regula­tions at 24 CFR part 58; c) The
grant recipient or other participants in the development process have committed
funds, incurred costs or un­dertaken activities not authorized by 24 CFR Part
58 before approval of a release of funds by HUD or the Massa­chusetts
Department of Housing and Com­munity Development; or d) another Federal agency
acting pursuant to 40 CFR Part 1504 has submitted a written finding that the
project is unsatisfactory from the standpoint of en­vironmental quality.
Objections must be prepared and submit­ted in accordance with the required
proce­dures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Mas­sachusetts
Community Development Block Grant, Department of Housing and Com­munity
Development, 100 Cambridge Street, Suite 300, Boston, MA 02114. Potential ob­jectors
should contact the Massachusetts Department of Hous­ing and Community
Development to verify the actual last date of the objection period.
