To the named Respondent and all other interested persons, a petition has been filed by Great Barrington Health Care of Great Barrington in the above captioned matter alleging that Doris Hayes is in need of a Guardian and requesting that Julia H. Durchanek, Esq. of Holyoke (or some other suitable person) be appointed as Guardian to serve Without Surety on the bond.

The petition asks the court to determine that the Respondent is incapacitated, that the appointment of a Guardian is necessary and that the proposed Guardian is appropriate. The petition is on file with this court and may contain a request for certain specific authority.

You have the right to object to this proceeding. If you wish to do so, you or your attorney must file a written appearance at this court on or before ten o’clock in the morning (10:00 AM) on 10/9/2018. This day is not a hearing date, but a deadline by which you have to file the written appearance if you object to the petition. If you fail to file the written appearance by the return date, action may be taken in this matter without further notice to you. In addition to filing the written appearance, you or your attorney must file a written affidavit stating the specific facts and grounds of your objection within 30 days after the return date.

The Great Barrington Conservation Commission will hold a public meeting on Wednesday, September 26, 2018 at 6:30 PM at the Great Barrington Town Hall, 334 Main Street, second floor meeting room, to act on a Request for Determination of Applicability submitted by Matthew L. Dodds for site preparation, including excavation, grading and driveway improvement, for a single family residence on Quarry Street, Map 20 Lot 130B. This determination will be conducted in accordance with the Massachusetts Wetlands Protection Act, Chapter 131, Section 40 and the Great Barrington Wetlands Bylaw and Regulations, Chapter 168 and Chapter 217 Article III.

CONSERVATION COMMISSION

The Great Barrington Conservation Commission will hold a public hearing on Wednesday, September 26, 2018 at 6:30 PM at the Great Barrington Town Hall, 334 Main Street, second floor meeting room, to act on a Notice of Intent from White Engineering, Inc. on behalf of Benjamin Wohlfert, property at 121 Bridge Street, Map 20 Lot 17. The proposed work consists of demolishing an existing single family house partly in the 100 year floodplain and constructing a new larger single family house in greater compliance with the Town of Great Barrington zoning setback and to allow for handicap accessible ramps to the house. This public hearing will be held in accordance with the Massachusetts Wetlands Protection Act, Chapter 131, Section 40 and the Great Barrington Wetlands Bylaw and Regulations, Chapter 168 and Chapter 217 Article III.

NOTICE OF PUBLIC HEARING

The Great Barrington Selectboard will hold a public hearing on Monday, October 15, 2018 at 7:00 PM at Town Hall, 334 Main Street, Great Barrington, MA, to act on the special permit application of 26 Manville, LLC, PO Box 628, Great Barrington, for a Water Quality Protection Overlay District Special Permit, in accordance with Sections 9.2 and 10.4 of the Great Barrington Zoning Bylaw, in order to increase impervious area of a lot by more than 15% or 2,500 square feet. Proposed impervious surfaces are in connection with a proposed development of 47 apartments in three new buildings, and associated parking, driveway and site work, at the site comprised of 21 Manville Street, 26 Manville Street, and 28 Manville Street.

Pursuant to 33 U.S.C. 1341 M.G.L. c. 21 S 43, notice is given of a 401 Water Quality Certification application for the replacement of the bridge carrying Berkshire School Road over Schenob Brook, bridge #S-30-022, in the Town of Sheffield, MA by the MassDOT Division of Highways, Ten Park Plaza, Room 4260, Boston, MA 02116. This project will involve the replacement of the existing bridge over Schenob Brook with minor adjustments to improve flow. Additional information may be obtained from the Massachusetts Department of Transportation Highway Division at the above address, Attention Susan McArthur, (857) 368-8807. Written comments should be sent to MassDEP, Southeast Region Main Office, Attention Christopher Ross, 20 Riverside Drive, Lakeville, MA 02347 within 21 days of this notice. Any group of ten persons, any aggrieved person, or any governmental body or private organization with a mandate to protect the environment who submits written comments may appeal the Department’s Certification. Failure to submit written comments before the end of the public comment period may result in the waiver of any right to an adjudicatory hearing.

On Tuesday, October 9, 2018 at 7:00 p.m. at the Sandisfield Town Hall Annex at 66 Sandisfield Road, the Board of Selectmen will hold a Public Hearing to determine the allocation of the local property tax levy among the four classes of Real Property for the Fiscal Year 2019. The Board of Assessors will discuss and present alternatives for allocation of the tax among the four classes of property. Interested parties are asked to attend.
