INVITATION TO BID

The Town of Egremont, acting through its Board of Selectmen, invites sealed bids from contractors for renovations to the Bathrooms at Town Hall. Plans and specifications are available starting June 8, 2018 at 2pm by email request with company name, address, and phone number included to: tegremont@egremont-ma.gov or at the Town Hall Board of Selectmen’s office, 171 Egremont Plain Road (Route 71), Egremont,.

The work to be performed includes demolition; removal and replacement of electrical and plumbing fixtures; wall, floor and ceiling finishes; removal and safe disposal of multi-layered flooring with assumed asbestos mastic and related work. All applicable federal, state and local laws, regulations and rules shall be observed.

Sealed bids from General Contractors, submitted on the proper forms and clearly marked “Town Hall Bathroom Renovations and Related Work” shall be received at the Board of Selectmen’s Office, 171 Egremont Plain Road (Route 71), Egremont (or via mail to PO Box 368, South Egremont, MA 01258) until 2:00pm Thursday, June 28, 2018, at which time they will be publicly opened and read aloud.

There will be a Pre-bid Conference at 8:00am on June 18, 2018, at the Egremont Town Hall, 171 Egremont Plain Road, Egremont, MA).

Prospective bidders must be OSHA trained.

The Bid Guaranty from each General Contractor shall be in the form of cash bid bond, certified check, Treasurer’s or Cashier’s check, drawn upon a responsible bank or trust company doing business in the Commonwealth of Massachusetts and shall be made payable to the Town of Egremont. The Bid Guaranty shall be five percent (5%) of the bid amount for General Contractors. A fifty percent (50%) Payment Bond with a surety company qualified to do business in the Commonwealth of Massachusetts will be required of the successful bidder within 7 business days of Notice of Award.

The work under this contract shall be subject to the provisions of Chapter 30, Section 39M of the Massachusetts General Laws. Wages are subject to Massachusetts’s minimum wage rates as required by M.G.L. Chapter 30, Sections 39M, inclusive. The contractor must certify that he shall not discriminate against any qualified employee or applicant for employment because of race, color, national origin, ancestry, age, sex, religion, or physical or mental handicap. The Contractor must agree to comply with all applicable Federal, State and Local statutes, rules and regulations, prohibiting discrimination in employment.

Selection of the contractor will be based upon bidder qualifications including evidence of past performance in similar projects, and bid price. The Contract will be awarded to the bidder deemed by the Awarding Authority to be the lowest responsible and eligible bidder.

The Town of Egremont reserves the right to accept or reject any and all bids, in whole or in part, to waive any informality in the bids received, and to accept the bid deemed to be most favorable to the best interest of the Town. The bidder agrees that its bid shall be good and not withdrawn for a period of thirty (30) days, Saturdays, Sundays, and legal holidays excluded, after the date of opening the bids.

The Town of Egremont is a municipal corporation and is exempt from the payment of sales and compensating use taxes to the Commonwealth of Massachusetts on all materials, equipment and supplies sold to the Contractor pursuant to this contract, to the extent authorized by G.L.c. 64H, Section 6(f). These taxes are not to be included in the bid. Copies of the Owner’s tax-exempt certificate will be available to the successful Bidder upon execution of the contract.

PUBLIC HEARING NOTICE

Notice is hereby given that the Board of Selectmen has received an Application for a Special Permit Hearing from Summit Hill Enterprises, Inc., to authorize an amendment to the original Special Permit granted in 1978, as amended in 1983, 1994 and in 2012. This request for amendment is to allow for the non-conforming residential use on the first floor while retaining the commercial use on the ground floor. The applicable section of the Zoning Bylaw: Section 199-9.8 Resorts. The property is non-conforming because it was constructed as a commercial office under EnlightenNext’s non profit zoning waiver. See, GL. CH 40A, §3; see also, Gund v. Planning Board of Cambridge 91 Mass. App. CT 813.

Failure to make recommendations on this matter shall be deemed lack of opposition thereto. Copy of the application and plans are available for review in the Selectmen’ s office, Memorial Hall, 32 Main Street, Lee, MA 01238. The hearing will take place in the Memorial Hall Courtroom on Tuesday, June 19, 2018 at 7:00 PM.

TOWN OF MOUNT WASHINGTON

PUBLIC HEARING

The Mount Washington Planning Board will hold a public hearing pursuant to the provisions of MGL 40A Section 5 on Tuesday, June 26, 2018 at 7:00 at Town Hall, 118 East St., Mount Washington, MA to provide interested parties with an opportunity to comment on proposed amendments to the Mount Washington Zoning Bylaws. The proposed amendments would add a Section 215-30, entitled Religious or Nonprofit Educational Camp Bylaw. Section 215-6. Special Permits A. (1) Camps, will be deleted and all subsequent sections would be re-numbered. The proposed amendments would add a Section 215-31, entitled Outdoor Illumination Bylaw. Copies of the proposed texts may be inspected in the Town Clerk’s office at Town Hall during office hours and copies will also be available on the town website. Any person wishing to be heard on these matters should appear at the time and place designated.
